The Executive Secretariat for Privatization and Partnerships of the city of São Paulo published Public Call Notice 002/2024. Its purpose is to call on companies interested in presenting studies, diagnosing scenarios and surveying operational, economic-financial and legal-regulatory viability to assist the municipal administration in designing a partnership for the implementation and operation of lotteries and betting in the city.
In the Notice, the City of São Paulo considers, in addition to other legal documents, Law 14,790, which regulates sports betting and online games in Brazil. In the modeling requested by the municipality, sports betting will be related to real sports-themed events or virtual online gaming events. In other words, São Paulo will also accept, as already provided for in federal legislation, online casinos.
The Notice and its annexes provide for the implementation of the following products:
Number lottery: one in which drawable elements are sold, the prize for which is offered in kind and/or in goods and the draw is carried out based on the results of official lottery draws or draws carried out by civil charitable or sports associations, supervised by the Administration Public;
Instant lottery: one with instant draws carried out in individual drawable elements, through the combination of numbers or symbols for the previously established prize distribution;
Conventional lottery: the one with the sale of previously numbered drawable tickets, in physical (printed) or virtual (electronic) media, the draw of which will take place on pre-determined dates, for distribution to winners of prizes announced in advance;
Sports prediction lottery: lottery in which the bettor tries to predict the outcome of sporting events;
Specific prediction lottery: indication, by the bettor, of a set of predictions about integers and a football club, defined as the Heart Team, contained in promotional forms, called flyers; and
Fixed odds betting: betting system relating to real sports-themed events or virtual online gaming events, as defined in Federal Law No. 14,790/2023.
Among the requirements, the City Hall hopes to receive a global vision of the project in the study, clearly identifying the most advantageous model for operating lottery services in the Municipality of São Paulo, with the best cost-benefit solution.
The studies requested by the City Council include:
a) PRODUCT I – Subsidies for Operational Modeling;
b) PRODUCT II – Market and Demand Diagnosis and Projection;
c) PRODUCT III – Subsidies for Economic-Financial Modeling; and
d) PRODUCT IV – Subsidies for Legal-Regulatory Modeling.
The Notice points out two scenarios to be considered in the study:
Scenario 1: it must be considered that the operating models for lottery services ensure exclusivity in the provision of services throughout the contractual term, that is, the services will be provided by a single natural or legal person; and
Scenario 2: it must be considered that the models for operating lottery services do not guarantee exclusivity in the provision of services throughout the contractual term, that is, the services may be provided by more than one natural or legal person simultaneously.
The deadline for requests for clarification is April 30th and for accreditation, May 3rd. Interested companies will have 60 days to present the studies requested in the Notice from the publication of the authorization by the Special Evaluation Committee of the City of São Paulo.
