With estimated revenue of US$ 2 billion, new Lotesul remains blocked in court

With projected revenues of R$9.8 billion (US$ 2bn) in ten years of operation, Lotesul remains stuck in court. In August 2022, the State government published a call for those interested in operating the public lottery service. Days later, NGT Brasil Tecnologia e Atividades Lotéricas Ltda filed a writ of mandamus at the Court of Justice of Mato Grosso do Sul, which annulled the notice.

According to a technical study attached to the case being processed at the MS Court of Justice, the Mato Grosso do Sul State Lottery could earn R$9.8 billion (US$ 2bn) in 10 years of operation. Of this amount, over 10 years, R$7.5 billion (US$ 1.46bn) will be distributed in prizes (payout).

Lottery revenue is the result of the sum of all "tickets sold" or bets placed in a given period. While payout is the sum of the value of the prizes distributed with the relative taxes. During this period, the MS government will have R$ 243 millions (US$ 47.4m) available to invest in social causes.

The call for companies interested in operating in Mato Grosso do Sul was launched in August 2022 and provided for the exploration of traditional lottery modalities, in physical and virtual environments, exclusively in the territory of Mato Grosso do Sul.

Days later, NGT Brasil Tecnologia e Atividades Lotéricas Ltda filed a writ of mandamus at the Mato Grosso do Sul Court of Justice, which annulled the notice. There is a limit of one company for every 2 million inhabitants. On the date of the action, the last 2010 Census had 2.4 million residents (total updated to 2.7 million in the 2022 Census).

In its appeal against the notice, the NGT alleged:

“The formation of a 'reserve register of Lottery Operators', as intended by the State of Mato Grosso do Sul, does not make the accreditation process valid, since effectively only one licensee will be hired per Lot, while the other companies, in which Despite being members of this supposed 'registration', they will not be hired and will not be able to operate for at least 5 years, the validity period of the permission.”

As a result, the Court of Justice of Mato Grosso do Sul annulled the notice and, now, the State Attorney General's Office awaits judgment on the appeal presented at the Superior Court of Justice.

The trial of the special appeal is scheduled to begin this week, in a virtual session that runs from May 21st to 27th.
