New standard indicates joint actio

Finance must receive approval from Ministry of Sports to authorize each betting license

The government announced that authorizations to operate sports betting in Brazil must be approved by the Ministry of Finance first and then also by the Ministry of Sports. In case of disagreement between the bodies, the request will then be submitted to the Attorney General's Office (AGU) so that it can also present an opinion.

The Interministerial Ordinance MF/MESP/AGU No. 28 outlines the roles and procedures of the Ministry of Finance, the Ministry of Sports, and the Office of the Attorney General of the Union in the application of the law for sports betting and online gaming.

As already established in Ordinance 827, which deals with the request for authorization to operate sports betting and online gaming, the responsibility will lie with the Secretariat of Prizes and Betting (SPA) of the Ministry of Finance. However, according to Interministerial Ordinance No. 28, the authorization can only be issued after approval from the Ministry of Sports.

In case of a disagreement between the evaluation conducted by the SPA and the Ministry of Sports, the issue will be submitted to the Office of the Attorney General of the Union.
 


According to the new document, the authorization request to operate sports betting and online gaming will be recorded in the Betting Management System (SIGAP) and submitted, after preliminary analysis by the SPA, to the Ministry of Sports. The ministry will have access to SIGAP in the same way as the Prizes and Betting Secretariat.

The new ordinance also state that it is the responsibility of the SPA and the Ministry of Sports, within their respective competencies, to ensure the integrity of the unpredictability and results of sports events that are the subject of sports betting.

The Ministry of Sports will notify the SPA of any indications of facts that may threaten the integrity and unpredictability of the events and sports results that are the subject of fixed-odds betting.

Ordinance No. 28 also states that it is the Ministry of Sports' responsibility to define and maintain an updated and publicly accessible list of sports modalities and sports practice entities that can be the subject of bets in real sports-themed events.

Correction of Ordinance SPA/MF No. 897

Also in this Thursday's (23) edition, the DOU includes a correction to Ordinance SPA/MF No. 897. In Article 15, which deals with the submission of the authorization request to operate sports betting and online gaming via SIGAP, a paragraph has been added stating that:

§ 1 The SIGAP can be accessed through the electronic address https://sigap.fazenda.gov.br.

All other rules remain unchanged.
