The state lottery model was approved by the Federal Supreme Court (STF) in 2020, which understood that the Union could not monopolize the service. In São Paulo, the system was approved in 2022 by the Legislative Assembly with the aim of bringing new sources of financing for public equipment in health and education, for example.
The forecast is that São Paulo will raise R$3.4 billion (US$ 635m) with the concession of the service, earmarked for health.
The São Paulo state lottery concessionaire will be able to offer services that will be in the form of predictions (specific, sports, numerical) and instant lottery (such as a scratch card, for example), in a physical and virtual environment. The choice will be up to whoever wins the auction for the concession.
According to technical studies, the spaces may be distributed according to the administrative regions of São Paulo. Based on studies on the installation of one point of sale for every 2,750 inhabitants, the estimate is that around 5,500 will be installed in the capital alone. The expectation is that the installation of points of sale by the dealer will maximize the expansion of service.
In addition to the estimated number of non-dedicated points of sale, the dealer will be required to install at least 31 exclusive points of sale distributed throughout the administrative regions of São Paulo. The objective is to serve as a concept store for the services provided and reach all regions of the state.
The installation of exclusive points of sale will follow some rules. For example, locations must have high visibility, with a large flow of people. Furthermore, the concessionaire must respect a minimum distance of 300 meters from daycare centers or primary and secondary education units.
The future concessionaire, according to the government's proposal, may choose to offer the same service virtually, such as websites and applications.
The concession of public lottery services in the State of São Paulo is part of the 13 auctions that the Government of São Paulo will hold until the end of 2024. The notice was launched in June and the auction should take place in the second half of the year. Arsesp (Public Services Regulatory Agency of the State of São Paulo) will be responsible for monitoring the concession and inspection of the services granted.
The future concessionaire will assume the responsibilities and risks with the possibility of exploring the gaming modalities, without the obligation to explore them all. The granting of lotteries will be a source of resources for financing public policies aimed at the health area.
