The National Association of Games and Lotteries (ANJL) clarifies that, regarding recent reports about potential crimes committed by influencers promoting the Fortune Tiger, popularly known as "jogo do tigrinho," Laws 13.756/2018 and 14.790/2023 have regulated the fixed-odds betting market in Brazil with clear rules for responsible advertising.
Any dissemination, advertising, or promotion related to fixed-odds betting must comply with legal and regulatory advertising standards, emphasizing responsible gaming, transparency, and clarifying that the betting market is always a form of entertainment - never a way to make money.
In this regard, it is understood that the "jogo do tigrinho" must comply with legal and regulatory rules, being a type of fixed-odds bet as provided by law.
The modality falls under the category of online games known as "slot games" and can be operated by betting sites under Law 14.790/2023 and sub-legal norms, provided that certain legal requirements are met, including informing the player in advance of the prize multiplication factor in case of winning the bet and having a defined random number generator in the rules system.
Thus, when Fortune Tiger meets legal and regulatory requirements, it does not qualify as gambling prohibited by the Penal Code.
Regardless, violations of responsible gaming, non-compliance with advertising rules and consumer protection norms, and fraud may constitute crimes under penal legislation.
The association emphasizes that the current stance does not concern the merits of recent operations by Civil Police in some states, initiated from investigations into influencers' activities.
The purpose of this note is to legally clarify the legality of this and other fixed-odds games, which already operate under legislation approved by the National Congress.
