‘Bets’ need to present objective prize multipliers

Fortune Tiger must have ‘pay tables’ to be authorized in Brazil

The Ministry of Finance is preparing an ordinance that should allow electronic gambling games, such as Fortune Tiger. The legalization of this modality will come within the regulation of online betting, a process that has been underway since the beginning of the year and should continue until August. For the Fortune Tiger or similar there will be specific rules. They can work as long as the sites present a pay table with a forecast of progressive gains throughout the game.

Initially, Finance had doubts about authorizing bets with variable winnings, such as the Fortune Tiger, since the winning value is not fixed nor known to the bettor when he starts the game.

This is the basis of betting: a player knows how much he will win if a certain result is achieved, for example, in a football match. The player knows that the result of a match will lead to a certain prize or loss — this is the model called fixed quota, a modality that was the subject of legislation by the National Congress at the end of last year.

Without the winning value clear to the player, the modality could not be considered fixed-odd. However, if companies clearly present the calculations made to multiply bettors' winnings, this could be considered a fixed quota. These are solutions that are capable of clearly informing the bettor about the multipliers that will be applied if they win.

Income statement

As O GLOBO anticipated in June, according to rules from the Ministry of Finance, online betting platforms must require income declarations from bettors and will have a lock to prevent them from spending too many hours playing.

They will also have to be hosted on a new internet domain determined by the government, "bet.br", from January 1, 2025. The measures aim to prevent bettors from compromising an excessive part of their street income with games and to curb frauds.

Initially, the sites will ask for a self-declaration of income, without the need for proof, before the bettor starts the game. This way, they will be able to know how much the value of bets represents in the players' personal income. The government does not rule out tightening control, requiring supporting documentation, if necessary.

‘Bets’ – as operator ara called in Brazil - will also need to ask users for identity authentication through facial recognition when the player enters the platform. Correct identification of the bettor should avoid the use of “scams” ??for money laundering, says the Ministry of Finance.

Sites outside bet.br will automatically be identified as irregular.

Technicians from the Ministry of Finance told GLOBO that the betting company that requests authorization by August will receive a response from the federal government by November.

Then, the company will have around a month to pay the grant of R$30 million (US$ 5.5m) to the federal government. Sites also need to be authorized by certifiers accredited by Finance.
