The National Association of Games and Lotteries (ANJL), for example, states that "Fortune Tiger consists of gaming, in the form of fixed odds [in which the player knows how much he can win according to the amount bet], and not gambling, prohibited by the Criminal Misdemeanors Law."
Fábio Jantalia, a lawyer specializing in betting and gaming, also says that the Fortune Tiger game fits perfectly into the concept of fixed-odds, in which the bettor, when playing, knows in advance how much he can win with the amount bet.
"In these aspects, the Fortune Tiger game is perfectly within the provisions of Law 14,790 and, therefore, can be offered regularly in Brazil, as long as there is a request for authorization for the offer here in Brazil," says the expert.
For the Ministry of Finance, however, so far, it is not possible to say whether the game meets the necessary criteria to be legally offered.
What should change with the new ordinance?
According to the Ministry of Finance, the ordinance scheduled for this month should ensure that online betting games meet some requirements to be legally recognized. One of them is that it will have to undergo certification issued by companies authorized by the department.
To date, four certificates have been approved: Gaming Associates Europe Ltd, BMM Spain Testlabs, eCogra Limited and Gaming Laboratories International LLC. These companies will certify whether the games follow legal and regulatory criteria.
"(In addition), the games must be offered by betting operators who have authorization," says the ministry. Authorized sites will be forwarded to bet.br.
According to the ministry, so far, only one platform has been requested to operate in Brazil – Kaizen, owner of the Betano brand. Companies interested in offering these games will have until December 31, 2024 to comply with the new legislation.
“From January 1, 2025, monitoring and inspection activities will begin and eventually sanction of companies that have been authorized. Those that do not obtain authorization from the Ministry of Finance will not be able to offer services at a national level.”
g1 asked the ministry whether, with the new rules, specifically the Fortune Tiger game will be banned or not, but until the publication of this report there was no response.
Experts also highlight that today slot games are mainly offered by platforms hosted in Malta, Curaçao, Gibraltar and the United Kingdom, even if they have Brazilian partners.
According to the ministry, with the law, only Brazilian companies can operate in Brazil, under conditions in accordance with national legislation that have obtained authorization from the Secretariat of Prizes and Bets.
“And eventually foreign companies that want to operate in the country will need to create a national company, which will follow Brazilian regulations.”
