New Zealand to introduce legislation to regulate online gaming

New Zealand’s Minister of Internal Affairs Brooke van Velden has confirmed that the country will regulate online casinos by 2026, a move aimed at minimizing harm, supporting tax collection, and providing robust consumer protections. This decision marks a significant shift in policy, reflecting a nuanced approach to balancing economic benefits with social responsibility.

The government plans to auction a limited number of licences, each valid for three years, with operators required to meet stringent regulatory standards. This approach ensures that only responsible and compliant operators can offer services to New Zealanders.

While the government’s plans are currently being developed Van Velden shared some details of the regulatory framework. Her department will be responsible for regulating New Zealand online casino operators.

There will be a licencing system for online casinos, where operators will need to comply with a set of criteria before they will be able to offer services to New Zealanders. It will be illegal for unlicensed operators to offer services to New Zealanders,” said van Velden.

Licensing is how we regulate most forms of gambling domestically. This is not intended to increase the amount of gambling New Zealanders do but to ensure operators meet requirements for consumer protection and harm minimisation, as well as paying tax.”

The minimum age for online gambling will be 18, and operators will only be able to offer online casino games, not sports betting or lottery products.

Licensed gambling operators will be allowed to advertise, which is currently prohibited, but with strict limits. Sponsorship by online casinos will remain illegal.

I expect the new regulatory system to be in place from early 2026 and the public will have the opportunity to provide feedback during the Select Committee process. Once established, the Department of Internal Affairs will be the regulator,” concluded van Velden.

Should New Zealand proceed with plan to regulate online casino, it will be the first major change to gambling under the new government. The National Party claimed victory in last year’s election, ending Labour’s stint in government.
