One of the main provisions of Ordinance SPA/MF No. 1,207 is the flexibility in the certification of betting games. According to Fabiano Jantalia, founding partner of Jantalia Advogados and a specialist in Gaming Law, it allows an operator to request certification for both internally developed games and those provided by third parties.
“This is particularly relevant for many bookmakers that use agreements with foreign game providers. In this way, the operator can request that the certifying entity issue a certificate in the name of the game provider or developer, facilitating the integration and legalization of foreign games in the Brazilian market.”
The Ordinance establishes that all games offered in Brazil must have a valid certificate, whether issued in the name of the bookmaker or the game provider. “This includes the need for an integration certificate between the bookmakers’ gaming platforms and those of the providers,” he highlights.
“This measure is crucial to ensure that all technological solutions are compatible and work harmoniously, providing a safe and reliable experience for the end user,” adds the specialist.
These regulations are designed to protect consumers in several ways. The Ordinance clearly defines the types of games that can be offered, the technical requirements for each of them and how prizes should be determined and calculated.
Furthermore, it stipulates how the odds should be reported, providing a more transparent and safe environment for bettors.
A notable aspect of Ordinance 1.207 is the emphasis on the reliability of online games. The new rules prohibit the presence of any hidden source code that could be exploited to circumvent the rules of the game.
“They also require that game results be displayed for a sufficient period of time so that bettors can calmly check whether the result matches their expectations. These measures are essential to ensure that games are fair and transparent,” Jantalia emphasizes.
In addition to increasing security for consumers, the Ordinance also makes it possible to separate legitimate games from fraud. For the lawyer, the massive supply of fake betting games, which use brands improperly, will be combated through a clear and verifiable licensing process.
“Bettors will be able to check on the Ministry of Finance website which games are authorized and for which operators, increasing confidence in the market,” he explains.
Finally, Ordinance SPA/MF No. 1,207 paves the way for a more rigorous and transparent licensing process. This not only ensures that the games offered are safe and fair, but also facilitates consumer access to clear information about the games authorized in Brazil.
