Kambi obtains injunction from Justice against Rio's sanction for companies not authorized by Loterj

The Federal Court of Rio de Janeiro granted an injunction to Kambi, a global sports betting platform, so that it can operate without having to comply with the state decree that regulates the Rio de Janeiro market. The decision, by the 27th Court, was handed down in a writ of mandamus filed by the company, and is valid until the judgment on the merits of the action.

The company appealed to the Judiciary due to an administrative proceeding opened against it by Loterj, which is responsible for overseeing the gaming and sports betting sector in Rio de Janeiro.

Kambi is challenging State Decree 48,806/2023, which imposes conditions for the operation of lottery modalities and determines administrative sanctions against operators not licensed by it.

In the lawsuit, Kambi claims that the government of Rio de Janeiro is asking Anatel to block betting sites not licensed by Loterj. According to the decision of Judge Geraldine Pinto Vital de Castro, the agency is prohibited from carrying out any act in the administrative proceeding, which should be suspended until a new deliberation by the Court.
 


The reasoning is that the Constitution of the Republic establishes that "it is the exclusive competence of the Union to legislate on consortium and lottery systems." Judge Geraldine de Castro highlighted that the regulation of this activity is currently established by Law 14,790, of 2023.

She acknowledges that the deadline for sports betting platforms to comply with federal rules is December 31 of this year, according to the article of the regulation of sports betting and online gaming that defined criteria for sportsbooks to seek their licenses and that until the last day of 2024 they would be within the “grace period” and could not be prevented from operating.
