ANJL: Completion of ordinances publication provides more security and clarity to rules for ‘Bets’

The National Association of Games and Lotteries (ANJL) believes that the publication of the last three ordinances regulating sports betting and online gaming, in the Official Gazette of the Union this Thursday (1), provides more security and clarity to all the rules for ‘Bets’ - - as operators are called in Brazil - to follow in the process of requesting authorization to operate in the country.

The three ordinances published deal with guidelines on advertising and publicity (Ordinance 1,231), including measures that must be adopted by the market to combat gambling addiction; sanctioning measures (Ordinance 1,233); and monitoring and inspection of activities (Ordinance 1,225).

For ANJL, the rules meet what the sector was already expecting, establishing practices that were already being adopted by operators, such as the prohibition of advertising to minors. The regulator's concern with this point was reinforced, in the ordinance on the sanctioning regime, by the provision of double the penalty in the case of any infractions involving the placing of fixed-odds bets by minors.

ANJL highlights that, in addition to the prohibitions regarding children and adolescents, the market itself self-regulated at the beginning of this year, through the development, together with the National Advertising Self-Regulation Council (Conar), of rules for advertising in the sector. The creation of Annex X of the Advertising Self-Regulation Code, with these guidelines, had the participation of ANJL.

Among the rules are the prohibition of inducing excessive betting, which can trigger addiction, and the promotion of betting as a means of making money or solving financial problems, which can result in the bettor getting into debt.

Regarding the inspection and sanctioning actions that will be adopted by the Prizes and Betting Secretariat (SPA), of the Ministry of Finance, starting January 1, 2025, the association considers that they bring the necessary rigor, including the provision of fines and the application of punishments to individuals in charge of operators, to bring order to the market and guarantee the integrity of the sector.

Now, with all the rules defined, companies will have the necessary understanding for this period of adaptation to the regulations, which runs until December 31 of this year. It is worth remembering that several betting houses have already started the process of requesting authorization underway with SPA. Those that manage to meet all the requirements for submitting the application by August 20 will be able to operate under the regulations, starting January 1,” explains Plínio Lemos Jorge, president of ANJL.
