Brazil’s Supreme Court rules that former ANJL president can remain silent in the CPI

Minister Flávio Dino, of the Federal Supreme Court (STF), assured the former president of the National Association of Games and Lotteries (ANJL), Wesley Cardia, the right to remain silent in the Parliamentary Commission of Inquiry (CPI) into the Manipulation of Games and Sports Betting, of the Senate, in relation to questions that could incriminate him. The testimony is scheduled for next Tuesday (6), at 2:30 pm.

The CPI is investigating allegations and suspicions of manipulation of results in Brazilian football, involving players, directors and betting companies.

Cardia was summoned as a witness to “investigate a request for bribes from a member of parliament” in exchange for support for the regulation of the sector and protection in the CPI of Sports Betting installed in the Chamber of Deputies, which ended in September of last year.

The decision was made in Habeas Corpus (HC 244362). According to Dino, based on the defense's allegations, it is plausible that Cardia was summoned as a suspect, and not as a witness, which justifies the granting of habeas corpus to preserve his rights.

He emphasized that the right to remain silent in criminal proceedings is linked to the principle of the presumption of innocence and aims to prevent involuntary confessions from being obtained. "It is up to the prosecution to prove the criminal responsibility of the accused," he stated.

Cardia will also have the right to be assisted by his lawyers and to communicate with them during the hearing and cannot be subjected to physical or moral constraints for exercising these prerogatives.
