Pending issues may include documents related to the certification of the betting system, online games, and their integration, or the need to complete specific documents or information.
Companies with provisional authorizations have a deadline of 30 days, extendable for an additional 30 days (if they present the necessary justifications as outlined in the regulation), to submit the mandatory technical certificates, such as security certificates for systems and game servers.
If they fail to comply, their authorizations may be suspended for up to 90 days, and if the non-compliance persists, their authorization will be permanently revoked, preventing them from operating.
Important deadlines for companies with provisional authorization
The regulation (Portaria SPA/MF No. 2.104/24) sets deadlines and procedures for the completion of certifications and documents related to the operation of sports betting and online games for companies that have obtained provisional authorization.
Here are the main points.
1. Completing the Certification
This refers to the technical certificates and betting systems (Sportsbook), Remote Game Server (RGS), and Integration, as outlined in items 1, 2, and 4 of Annex VI of Portaria SPA/MF No. 300/24, as stated in art. 14, item V, of Law 827, according to art. 3 of Portaria SPA/MF No. 2.104/24.
Deadline: 30 days from the publication of the regulation.
Extension of Deadline: One extension is allowed for the same period, provided a request is made along with a statement from the certification laboratory confirming the need for the extension to conduct tests and issue certificates. Failure to comply will result in a 90-day suspension. Sports betting and online gaming are prohibited during the suspension.
If the suspension deadline is not met, the provisional authorization will be revoked, and the administrative process will be permanently archived.
2. General document completion
Refers to the requirements of art. 14, items II, III, IV, and VI of Law 827, as stated in art. 2 of Portaria SPA/MF No. 2.104/24.
Deadline: 30 days from the notification sent by the Secretary of Prizes and Bets.
Penalty for Non-compliance: Revocation of the provisional authorization and permanent filing of the administrative process.
3. Presentation of online game Certification and live game studios
Refers to the technical certificates outlined in items 3 and 5 of Annex VI of Portaria SPA/MF No. 300/2024.
Deadline: 30 days after the publication of the regulation.
During this period, only online games, including live studios, that comply with the requirements of Portaria SPA/MF No. 1.207/24 and have been properly certified (i) under items 3 and 5 of Annex VI of Portaria SPA/MF No. 300/24 or (ii) for another jurisdiction based on international rules by a certifying body recognized by the Ministry of Finance, can be offered.
