Betting secretariat opens public consultation, calls for a hearing to discuss regulatory agenda

The Secretariat of Prizes and Betting (SPA) of Brazil's Ministry of Finance (SPA/MF) invites citizens, companies, experts, and consumers-bettors interested in contributing to the development of its regulatory agenda for the 2025/2026 biennium to participate in a public consultation. For those interested in making verbal contributions, the SPA is also promoting Hearing No. 01/2025 (virtual), to be held on Friday, February 21, from 2:00 p.m. to 4:00 p.m.

Registrations must be made through this link available on the Ministry of Finance website. The SPA/MF is committed to promoting technically consistent and transparent regulation, marked by legal certainty and guaranteed participation and dialogue with those involved. Despite the relatively recent establishment of the Secretariat, the department has made important deliverables:

- Preparation of 34 standards or documents that establish rules or establish understandings about regulation (including Ordinances, Normative Instructions and Technical Notes)

- 68 betting operators authorized according to the requirements of the legislation

- More than 11,600 irregular websites mapped and blocked

- Publication of an Interministerial Working Group to deal with Responsible Gaming and Prevention of Problem Gambling.

In order to deepen this commitment and plan the next steps, the SPA prepared a proposal for a regulatory agenda, which is now being submitted for public consultation. As reference documentation for the topic, it refers to:

- Decree No. 11,907/2024, which in its articles 55 to 58 deals with the powers of the SPA/MF;

- Legislation that legalized the fixed-odds lottery betting modality in Brazil: Law No. 13,756/2018 and Law No. 14,790/2023;

- All regulations issued by SPA/MF, available here, such as the following Ordinances:

- Ordinance SPA/MF No. 827/2024, which establishes rules and conditions for obtaining authorization to operate betting activities;

- Ordinance SPA/MF No. 1,231/2024, which establishes rules and guidelines for responsible gaming and for communication, advertising, publicity and marketing actions, and regulates the rights and duties of bettors and operating agents;

- Ordinance SPA/MF No. 1,143/2024, which regulates policies, procedures and internal controls for preventing money laundering; and

- Ordinance SPA/MF No. 722/2024, which regulates the technical and security requirements of betting systems.

The proposed regulatory agenda that we are now submitting for public consultation comprises 14 priority projects to be developed by SPA/MF during 2025/2026, each associated with its respective objective.

Each project is also associated with the date scheduled for its submission to some type of preparation, consultation or participation procedure (for example, public input, internal consultation or public consultation). The 14 priority projects are classified in at least one of the following thematic axes:

A) Promotion of Responsible Gambling, Prevention of Pathological Gambling and Mitigation of Externalities;

B) Promotion of a balanced and transparent regulatory environment with adequate levels of compliance; and

C) National strengthening of regulation and oversight.

Proposed regulatory agenda 2025-2026:

* Project 1: Implementation of rules for consulting and sharing data on self-excluded bettors and those prevented from betting

Axes: A; B

Objective: To contribute to the effectiveness of regulatory standards related to Responsible Gaming and the prevention of Pathological Gambling provided for in Ordinance SPA/MF No. 1,231/2024, including respect for the autonomy of the decision to self-exclude bettors by betting operators and the list of people prohibited and prevented from betting provided for in Art. 26 of Law 13,756/2018, ensuring this observance horizontally in the segment

Expected date for consultation: 2025.2

* Project 2: Improvement of the implementation model for the allocation of resources in exchange for the use of the image, names and sports nicknames of athletes, as well as sports symbols, anthems and other rights, provided for in §1º-A, item III, item "a", and in §§6º and 7º, of Art. 30 of Law 13,756/2018

Axes: A; B

Objective: To improve the mechanism provided for in Law No. 13,756/2018 due by betting agents for the use of image rights and similar rights to athletes and sports organizations, a model currently regulated by Ordinance SPA/MF No. 41/2025

* Project 3: Regulation of rules for qualifying the import of equipment for online studio companies

Axes: B; C

Objective: Regulate the import of equipment by companies that provide online games in live studios, creating rules for carrying out this activity within the country; this type of online gaming is already provided for in the regulation of fixed-odds betting, however, customs systems still require such rules to have criteria and requirements for the import of betting machinery, which will be of restricted use under the terms of the law and regulation. In order for the Federal Revenue and the Foreign Trade System and SISCOMEX to be able to implement the import rules, it is necessary for the SPA to regulate the subject

* Project 4: Definition of parameters for the creation of a distinctive seal for Authorized Betting Operator agents

Axes: A; B; C

Objective: To contribute to the adequate differentiation of regulated betting operators (authorized by SPA/MF) in relation to the irregular market, by encouraging the creation of a tokenized seal for the exclusive use of betting operators

* Project 5: Improvement of regulations and procedures related to commercial promotion, including review of SEAE/ME Ordinance No. 7,638/2022 and others, modernization of authorization and sanctioning procedures, as well as evaluation of a possible review of Decree No. 70,951/1972

Axes: B

Objective: To contribute to greater effectiveness in the use of personnel resources and to greater efficiency and rationalization of authorization and sanctioning procedures related to commercial promotions; update procedures in light of the new structure with simplification of procedures and debureaucratization, in addition to improvements in the SPC - Commercial Promotion System

* Project 6: Review of the regulation on the Exclusive Instant Lottery - LOTEX

Axes: B

Objective: To improve the current LOTEX model, provided for in art. 28 of Law 13.155/2015, in art. 2 of Law No. 13.262/2016, regulated by Decree No. 9.327/2018 and authorized by Ordinance MF No. 1.646/2023

* Project 7: Regulation of the economic chain associated with betting operating agents: online gaming providers and other types of service providers

Axes: A; B; C

Objective: To contribute to the consolidation of the Brazilian betting ecosystem based on regulatory guidelines that apply vertically to service providers beyond betting houses, contributing to greater effectiveness of domestic guidelines and greater responsiveness of the various economic agents; in this first phase, focusing on online gaming providers, online gaming aggregators, live gaming studios, gaming platform providers and odds providers; This Project will discuss, for example, the possible need to establish prior qualification or another regulatory recognition mechanism for certain types of service or goods suppliers.

* Project 8: Creation of a National Betting System

Axis: C

Objective: Contribute to cooperative federalism and the systemic national nature of the regulation of prizes and bets, through coordination with the States, the dissemination of good practices and minimum national standards for Responsible Gaming, technical requirements for systems and games, Combating Money Laundering, Sports Integrity

* Project 9: Consolidation and improvement of inspection procedures

Axes: A; B; C

Objective: Improve procedures and standards related to the inspection of authorized betting operators and the digital environment in general (including irregular platforms)

* Project 10: Improvement of service to consumer-bettors and family members in Situations of Addiction or other disorders associated with Problem Gambling

Axes: A; C

Objective: Improve guidelines and rules for adequate service, by betting operators, to consumer-bettors and family members, who are experiencing a situation of Problem Gambling (including addiction or related disorders). Decree No. 11,034, of 2022, which regulates the Consumer Service (SAC), does not sufficiently cover the particularities of the betting segment. This project aims to map the practices of the segment, discuss and identify good practices and develop a regulatory initiative, within the scope of the service channels aimed at the consumer-bettor, in order to contribute to the preservation of the mental health of consumer-bettors and to the mitigation of damages associated with the activity.

* Project 11: Review of the procedure for authorizing betting operators provided for in Ordinance SPA/MF No. 827/2024

Axes: B; C

Objective: Improve the procedure provided for in Ordinance No. 827/2024, incorporating lessons learned from the first cycle of authorizations

* Project 12: Review of Ordinance SPA/MF No. 300/2024, which regulates requirements and procedures for recognizing certifiers of betting systems, live gaming studios and online games

Axes: B; C

Objective: Contribute to the consolidation of the regulated and balanced national betting system, with greater responsiveness and adherence to domestic regulatory guidelines in the betting certification segment (discussing, for example, the possible need for an office in the country and the presence of teams in the national territory with exclusive dedication)

* Project 13: Review of the regulation and implementation of procedures related to the popular savings collection modality provided for in art. 7th of Law No. 5,768/1971

Axis: B

Objective: To modernize the procedures related to the authorization requirement for the "popular savings collection" modality by introducing innovations to the model regulated by Ordinance SEAE/ME No. 7,660/2022 and assessing the need to review articles 31 to 67 of Decree No. 70,951/1971

* Project 14: Review of the sanctioning regime within the scope of the commercial exploitation of the fixed-odds lottery modality

Axis: B; C

Objective: To improve procedures and standards (Ordinance No. 1,233/2024) related to the sanctioning of violations of the legislation of the fixed-odds lottery modality
