Lottopar extrajudicially notifies municipalities for irregular actions in lottery operations

Lottopar extrajudicially notified this Monday (10) the city halls of Bodó (Rio Grande do Norte) and Miguel Pereira (Rio de Janeiro), for the irregular granting of accreditation to lottery operators, allowing the operation of the activity outside the municipal jurisdiction.

Lottopar's measure is based on the understanding consolidated by the Federal Supreme Court in ADPFs 492 and 493 and in ADI 4,986, which recognizes lottery operation as a public service under the jurisdiction of the States and the Federal District, and not of the municipalities.

In addition, federal legislation (Law No. 13,756/2018, amended by Law No. 14,790/2023) determines that the marketing and advertising of state lotteries must occur within the territorial limits of each State.

Lottopar has identified that operators accredited by Bodó (RN) and Miguel Pereira (RJ) have been operating irregularly in the state of Paraná, disregarding current legislation. This practice violates public order and generates unfair competition among operators duly accredited in the state.

In light of this scenario, Lottopar has notified the city governments involved, requesting that these irregular activities be immediately ceased, under penalty of the adoption of appropriate legal and administrative measures.

Lottopar reinforces its commitment to legality and legal certainty in the lottery sector, ensuring that the operation of this public service occurs within legal parameters and with due supervision.

It is now up to the municipalities to comply with legal requirements; otherwise, Lottopar will take the appropriate measures to cease the irregular operation of lottery services by operators linked to Bodó/RN and Miguel Pereira/RJ.

Geolocation

Sites authorized by the State of Paraná comply with the provisions of Federal Law, that is, they only allow new registrations and bets from people duly located in the State of Paraná.
