SPA and National Consumer Secretariat sign agreement to protect bettors' rights

The Secretariat of Prizes and Betting (SPA) of the Ministry of Finance and the National Consumer Secretariat (Senacon), of the Ministry of Justice, signed a Technical Cooperation Agreement (ACT) to protect the rights of bettors in the regulated market of the so-called ‘Bets’, composed of operators, preventing and mitigating negative externalities in this sector. The companies will have to register on the consumer.gov.br platform.

The SPA and Senacon have committed to producing informational materials on consumer rights within this entertainment market, both with guidelines aimed directly at bettors and to instruct members of the National Consumer Defense System, composed of state and municipal Procons, public defenders' offices, the Public Prosecutor's Office and civil consumer defense entities.

Joint initiatives are also planned with Senacon's National Consumer Defense School, promoting training and guidance aimed at raising awareness among bettors.

As part of the commitment made in the ACT, it is worth highlighting the reinforcement of the requirement that all betting companies participate in the consumer.gov.br platform. In addition to expanding consumer protection, this measure will also serve as a monitoring tool for SPA, allowing it to closely monitor the companies' performance in the market.

The two departments have committed to constantly exchanging information in order to assist in the efficiency of the partner's work. This joint action will allow for more effective monitoring of the sector's practices and the protection of bettors' rights.

The partnership between SPA and Senacon is an important tool for one of the pillars of the regulation of fixed-odds betting, which is the guarantee of bettors' rights. In a market as new as this one, providing people with information is especially important,” said the Secretary of Prizes and Betting, Regis Dudena.

For the National Secretary of Consumer Affairs, Wadih Damous,the ACT reinforces Senacon's commitment to consumer protection, ensuring that bettors have their rights respected and access to effective protection mechanisms.”

He also highlighted that, in addition to the requirement to join the consumer.gov.br platform, the agreement provides for the creation of a direct communication channel between the SPA and consumer protection agencies, allowing for the rapid identification of complaint patterns and possible irregularities in the sector.

This strategic cooperation aims not only to strengthen oversight, but also to foster a safer and more transparent betting environment, in order to prevent abuse and ensure that companies operate in compliance with current legislation.

Fixed-odds betting is a lottery modality legalized as a public service in December 2018, expanded by Law 14.790/2023 and regulated by several SPA Ordinances from 2024.

Last year, there was a transition period for companies to adapt to the new rules. On January 1st of this year, the regulation came into effect and only authorized companies can offer their services. One of the rules is the use of the extension “.bet.br”, exclusive to authorized sites.
