Mato Grosso do Sul publishes a notice to select the company that will operate Lotesul

The government of Mato Grosso do Sul has published a new notice to select the company that will operate Lotesul, a state lottery that has been suspended for almost 20 years. The electronic auction is scheduled for March 17 and seeks a specialized company to implement a technological system to control lottery activities.

The initiative, which was resumed in 2021, foresees that 50% of the resources will be allocated to housing programs. A previous notice, from 2022, was canceled after a decision by the STJ that accepted a request from NGT Brasil Tecnologia.

According to technical studies, the lottery could generate revenue of R$ 9.8 billion (US$ 1.7bn) over 10 years, of which R$ 7.5 billion (USS 1.3bn) will be distributed in prizes.

According to the announcement, the intention is to hire a specialized company to implement and operate a technological solution that controls lottery activities, integrated with payment methods, to manage and control the activities and financial flow of the lottery operators of the State lottery.

This also includes maintenance, customization and updates required during the contract, with full delivery of the source code and database upon contract completion.

The electronic auction is scheduled to take place on March 17, at 8:30 am, at www.compras.ms.gov.br.

Campo Grande News contacted Sefaz to obtain more details, which said that this will be a new modality.

Lotesul

In 2021, Reinaldo Azambuja, governor at the time, sanctioned the return of the service in the State. According to the law sanctioned that year, 50% of these resources would be allocated to financing programs in the housing area. The Executive Branch allocated R$146,000 (US$ 25,000) in additional credits in the 2021 financial year to comply with the law.

Then, in August 2022, the government published a notice for interested parties to operate the new version of Lotesul, but it was challenged in the STJ (Superior Court of Justice).

Decisions from the first and second instances, in Mato Grosso do Sul, granted the request by the Paraná company NGT Brasil Tecnologia e Atividades Lotéricas Ltda.

Interested in operating the service, the company's lawyers filed a writ of mandamus against the notice, pointing out that the government did not launch the bidding to select just one company, but a public call in which several could meet the requirements.

The State Attorney General's Office (PGE) filed an appeal, but the STJ upheld the decision to annul the notice in June 2024.
