CPI analyzes confidentiality breach of 71 ‘Bets’ authorized by the government

In the first meeting of the year, the Parliamentary Inquiry Commission (CPI) of ‘Bets’ will decide on the breach of banking and tax confidentiality of almost all operators of virtual betting authorized by Brazil’s government. The meeting is scheduled for this Tuesday (11), at 11 am. It involves 97 requests from Senator Marcos Rogério presented at the beginning of December, which include 71 of the 78 companies currently authorized by the Ministry of Finance.

The documents request, among other data, that the Financial Activities Control Council (Coaf) forward to the CPI financial intelligence reports (RIFs) with “consistent information” about betting, for the period from January 1, 2020 to December 10, 2024.

Another 11 requests summon authorities from the Central Bank and the Federal Police as witnesses, as well as representatives of betting companies and payment institutions. The summons makes attendance mandatory.

Testimony

Before the votes, the committee will hear from the Special Secretary of the Brazilian Federal Revenue Service (RFB), Robinson Barreirinhas, head of the agency responsible for administering federal taxes. This is an invitation to collaborate as an expert.

According to the request from Senator Izalci Lucas, who authorized the invitation, the betting sector is still awaiting regulations that clarify the taxation of prizes and prevent tax evasion.

“The current legislation does not clearly specify how these prizes should be taxed, which creates a loophole so that taxes are not collected efficiently. The Federal Revenue Service fears that the lack of regulatory clarity will favor tax evasion and reduce the potential for collection,” the document states.

Barreirinhas has already contributed on a similar topic to the CPI on Game Manipulation and Sports Betting, in September 2024.

CPI on ‘Bets’

The committee seeks to clarify the impact of digital betting on the financial health of Brazilians and investigate possible illicit activities. Installed on November 12, the CPI elected Senator Dr. Hiran as president and Senator Soraya Thronicke as rapporteur. The committee has a total of 130 days to complete its work, with a spending limit of R$110,000 (US$19,000).

The games created by the sector and that are pending regulation are called “fixed-odds bets”, which refer to online sports betting and online games that resemble casinos (such as Fortune Tiger, popularly known as ‘Jogo do Tigrinho’). The “fixed odds” are those that allow the bettor to know in advance how many times more he will receive on the amount bet, if he wins.

The result of a CPI may include, among others, proposals for changes in legislation and the referral of investigations to agencies responsible for holding the accused criminally accountable.
