Municipal and state lotteries reject use of ‘.bet.br’ domain to identify illegal transactions

The National Association of Municipal and State Lotteries (ANALOME) rejected Ordinance SPA/MF No. 566, which defines the ‘.bet.br’ domain as a criterion for identifying illegal transactions. They consider the rule to be detrimental to legality, free initiative and the autonomy of federative entities, generating legal uncertainty. The association requests its repeal and suggests that a working group discusses solutions respecting the autonomy of states and municipalities.

According to ANALOME, this creates a climate of legal uncertainty, harming operators that comply with current legislation. The requirement for the ‘.bet.br’ domain disregards the reality of the sector, where various operations regulated by states and municipalities use other domains. This restriction violates the principle of legality (Article 5, II, of the 1988 Federal Constitution) and constitutes an abuse of the federal government's legislative authority.

The organization’s concern is the continuity of lottery operations that fund essential areas such as health and education in the states. ANALOME views this rule as an attempt by the Secretariat for Prizes and Betting (SPA) to maintain, through indirect means, a monopoly over lottery operation, something that is neither supported by current legislation nor by Supreme Federal Court jurisprudence. This approach creates obstacles that favor certain actors to the detriment of state and municipal autonomy.

The National Association of Municipal and State Lotteries (ANALOME) expresses its strong rejection of SPA/MF Ordinance No. 566, published on March 21, 2025, by the Secretariat for Prizes and Betting of the Ministry of Finance. This regulation, by establishing the “.bet.br” domain as the exclusive criterion for identifying illegal betting operations, imposes a misguided restriction that violates the principles of legality, free enterprise, and the autonomy of federative entities.

The Ordinance creates a climate of legal uncertainty, harming operators that comply with current legislation. The requirement for the ‘.bet.br’ domain disregards the reality of the sector, where various operations regulated by states and municipalities use other domains. This restriction violates the principle of legality (Article 5, II, of the 1988 Federal Constitution) and constitutes an abuse of the federal government's legislative authority.

Although the Ordinance aims to combat illegal activities, the adopted criterion lacks legal support and threatens the continuity of lottery operations that fund essential areas such as health and education. This inappropriate requirement is not an effective tool to curb irregularities, directly affects public policies, and generates uncertainty for operators and beneficiaries.

Given this scenario, ANALOME urges the Secretariat for Prizes and Betting to revoke Ordinance SPA/MF No. 566/25, correcting this serious violation of the legal framework and preventing irreparable harm to the gaming and entertainment industry. Additionally, it advises its members to take appropriate legal action, including the possible filing of a writ of mandamus to protect their activities.

Furthermore, the Ordinance reveals an attempt by the Secretariat for Prizes and Betting to establish an indirect monopoly over lottery operations, which is neither supported by current legislation nor by Supreme Federal Court jurisprudence. This approach creates barriers that favor certain actors to the detriment of state and municipal autonomy.

ANALOME reaffirms its commitment to combating illegal practices within constitutional limits and proposes the creation of a Joint Working Group with representatives from the Secretariat for Prizes and Betting to analyze the impacts of the Ordinance and seek solutions that ensure legal security while respecting the autonomy of federative entities.

We believe that technical dialogue is essential for developing a fair regulatory framework. While this proposal does not exclude the possibility of legal action, it demonstrates our commitment to reaching consensual solutions.
