
The measure was granted after Pixbet filed a writ of mandamus against the Secretary of Prizes and Betting, Régis Dudena. The company, represented by attorney Nelson Wilians, argued that it had met all legal requirements to operate in the sector, including paying the R$30 million (US$5.1m) licensing fee and providing a R$5 million (US$855k) financial guarantee.
The dispute originated from the requirement of four technical certificates. Three were submitted in February, and the fourth—related to integration—was filed on April 10, shortly before the suspension was made official, but after the initially stipulated deadline.
In its ruling, the court understood that the purpose of the ministerial ordinance is to ensure the technical security of operations, not to impose disproportionate penalties for delays. Since all four certificates were delivered, the company was allowed to resume its operations.
The injunction also took into account the immediate economic impact that the suspension would bring, especially regarding the sponsorship contract with Flamengo, valued at R$470 million (US$80m) through 2027.
The decision prevented damage to the brand’s image, particularly as the team’s official debut in the Brazilian Championship took place this Sunday (April 13) against Grêmio. According to the ruling, the fact that the ordinance was published on Friday made it "impossible" for Pixbet to seek immediate reauthorization before the match.
“There is periculum in mora because, as the suspension was published on 04/11/2025, the party was unable to administratively seek the immediate restoration of its authorization before the Brazilian Championship match scheduled for 04/13/2025 involving the club it sponsors,” the judge stated in the decision.
“With the delivery of all certificates, even if one was late, it is clear that the requirement was fulfilled. Penalties should not be applied when there is good faith and the obligation has been fully met,” said Nelson Wilians. “Therefore, the company is once again authorized to operate fixed-odds betting, according to the injunction granted.”
The other three companies suspended under Ordinance 787 are TQJ-Par Participações Societárias S.A. (Baú Bingo, Tele Sena Bet, and Bet Do Milhão) of the Sílvio Santos Group; 7MBR LTDA (Cbet); and Caixa Loterias S.A. (Betcaixa, Megabet, and Xbet Caixa).
