
MEsp Ordinance No. 31 regulates the supervision of sports betting websites and establishes a team composed of one director and three general coordinators. They will be responsible for periodically analyzing betting sites to ensure compliance with legal and regulatory requirements, covering, among other essential aspects, the following:
I – Verification of the validity of the commercial brand used by the betting operator, ensuring it matches the brand registered in the authorization process with the Secretariat of Prizes and Betting (SPA) of the Ministry of Finance;
II – Review of the sports betting options offered, ensuring they are in accordance with the list established in MEsp Ordinance No. 125, dated December 30, 2024, and any subsequent updates; and
III – Identification of any practices that may violate current regulations, such as offering prohibited bets or lacking effective mechanisms to prevent the participation of minors.
If any irregularities are identified, the technical team will prepare a detailed report describing the non-conformities, which will be forwarded to the SPA of the Ministry of Finance for appropriate measures.
The Departments of Promotion, Entrepreneurship and Digital Economy in Sports, eSports, and Integrity in Sports Betting will provide technical support—within their respective competencies—to the Directorate of Monitoring and Evaluation of Sports Betting and the Technical Team in carrying out the periodic analyses.
The ordinance also establishes that the Ministry of Sports may develop and implement a platform to ensure the integrity of sports operations in the sector. Additionally, it may enter into partnerships with regulatory agencies, federal entities, educational and research institutions, universities, technology companies, and international organizations to improve oversight tools and processes.
