Brazil discusses a law to disclosure lottery winners

A bill that can make it compulsory to identify lottery bettors through the national Physical Register is being considered in the the Brazilian Federal Senate. The measure aims to combat possible cases of fraud and money laundering, giving greater transparency to draws and prizes payments made by state-owned bank Caixa Econômica Federal.

The proposal is made by Senator Paulo Bauer (PSDB / SC). He justifies that "in the face of so many deviations, frauds and corruption that devastate the country, one can not ignore the hypothesis that this is happening with lottery games."

Currently, it is not necessary to present any documents to bet on any Brazilian lotteries. Neither does Caixa reveal names or information of the winners following the provisions of item X of article 5 of the Federal Constitution ("privacy, honor and image of persons are inviolable").

In the original text of the Project, Bauer asked lottery administrators to disclose names, CPFs and households of the winners on their websites. Opinion of the rapporteur Pedro Chaves (PRB / MS), however, made safety concerns and ensured the secrecy regarding the identification of bettors.

"Brazil has had frightening rates of violence ... Therefore, we understand that by disclosing the names of people who have won lottery prizes with their respective data, we will be creating a security problem for citizens who win lottery prizes," wrote the rapporteur.

"However, it is necessary to increase the number of information available to the control bodies, in order to facilitate the investigation of the occurrence of crimes of money laundering or concealment of assets, rights and values. To do so, it is sufficient to register the number of the CPF of the players at the moment of their bets, so that the agents paying the prizes can check if the number entered in each bet coincides with the number presented in the withdrawal of the respective prize, "he added.

ADVERTISING IS COMMON, BUT IT HAS BEEN A CASE OF JUSTICE OUTSIDE OF BRAZIL

Revealing the identity of lottery winners outside Brazil is common. In the United States, 44 of the 50 states is a must. In 2017, for example, Mavis Wanckyz gave up a press conference after earning US$ 758 million on the Powerball.

However, another case draws attention precisely because the winner has had to fight in court to remain anonymous. A woman won US$ 560 million in the same Powerball in January 2018, but signed her ticket with a pseudonym. It was a two-month legal battle and the claim that maintaining her security and privacy would outweigh the interest public to reveal their identity until she had a favorable sentence.

POPULAR REJECTION

Security or privacy issues aside, Bauer's proposal does not have popular support. On the page of the Bill on the website of the Federal Senate, where it is possible for any citizen to comment on the matter, 90.8% of votes are against approval.

On July 4th, the matter was referred to the Senate Economic Affairs Committee.
