Justice suspends draws of lottery game firm "Bilhetão Solidário" in Brazil

The Court ruled that the gaming company Bilhetão Solidário of Campina Grande and three of its members are not allowed to advertise, market tickets, and carry out draws across the state of Paraíba in Brazil. If the measure is not complied with, a penalty of a daily fine to be duly established by the court is provided for.

The measure was deferred after a lawsuit filed by the Federal Public Ministry (MPF) in Campina Grande. The court also granted MPF an injunction to block the assets owned by the defendants, up to a limit of R$ 1 million, as well as the seizement of movable property at the company's headquarters, classified by the Public Prosecutor's Office as a legal entity that promotes an authentic public offering of games of chance, prohibited in Brazil by virtue of Decree-Law no. 3.688/41, Article 50).

In the action, the MPF wants the definitive closure of the company's activities, as well as the condemnation of the defendants in collective moral damages, since it consists of "an authentic public offering of gambling completely dissociated from the legal parameters stipulated for the authorized practice of games of this kind, as well as deceiving and misleading a wide range of consumers in municipalities in Paraíba, which implies the necessary intervention of the Judiciary to suspend commercialization and no longer allow such practice to return under new ways, although apparently legitimate."

Still according to the action, the company "use an approach that refers to charitable or philanthropic institutions to give greater appearance of legitimacy to their own operations." Currently, tickets were being marketed under the name "certificate of contribution" promoted by the Research Institute Professor Joaquim Neto (Ipesq), hiding the lucrative and illegal purpose of the company.
